Conservation Commission Minutes 03/09/10
EASTHAM CONSERVATION COMMISSION

PRESENT:        Glenn Collins, David Hoerle, Steve Smith, Sandra Larsen, Lorraine Giovinazzo, Steve LaBranche, Dennis Murley.
 
STAFF PRESENT:  Deputy Natural Resource Officer Amy Usowski.  
  
ALSO PRESENT:   Amy and Marc Costa for the Provincetown Center for Coastal Studies, jason Ellis of J.C. Ellis Design Co., Inc., Noel Beyle, Hank Skehan, Bob Carlson, Tim Brady.

Chairman Murley opened the meeting at 7:00 P.M.

The Commissioners reviewed the Minutes of 09 February 2010.  Mr. Hoerle MOVED and Mr. Smith SECONDED the Motion to approve the Minutes of 09 February 2010.

SO VOTED UNANIMOUSLY.

7:03 P.M.       Request for a Certificate of Compliance, Brothers, DEP SE 19-948, 165 Shurtleff Road, Map 10, Parcel 240.  

Deputy Usowski reviewed this request for the Commissioners.  This project was for the construction of a house and a re-vegetation plan.  The Commissioners had wanted to make one last site visit before voting on this matter.  She reminded them that there were still some outstanding issues at this site; but, they have nothing to do with this particular Order of Conditions and can be handled separately.  

Mr. LaBranche MOVED to grant a Certificate of Compliance for DEP SE 19-948.  Mr. Smith SECONDED the Motion.

SO VOTED UNANIMOUSLY.





7:05 P.M.       Request for a Certificate of Compliance, Snider,DEp SE 19-1358, 205 Herringbrook Road, Map 17, Parcel 489.

Deputy Usowski reviewed this project for the installation of a Title V septic system upgrade within 100' of a Coastal Bank and the 120 sf. expansion of an existing patio.
She said that the disturbed area was to be re-planted with native plants and a “No Mow” zone established at the 75' contour, delineated by a permanent marker.  She said that this has not been put into place yet.  She said it has only been one growing season and the Commission can wait for three years; ut, it looks as though the area is being used.

Chairman Murley commented that even if it can ben excused because it’s only been one growing season, the permanent marker should be in place delineating the “No Mow” zone, and this would be critical in issuing a Certificate of Compliance.

It was agreed to hold any action on this request, at least until a permanent delineation of the “No Mow” zone has been put in place.

7:08 P.M.       Request for Administrative Review filed by Alice Webber, 1420 Samoset Road, Map 13, Parcel 221.

Deputu Usowski explained the Applicant’s request to remove three Pines and two Oaks within the 100' Buffer Zone to the Salt marsh and the Top of the Coastal Bank.  She said she was unable to speak with the Applicant so she doesn’t exactly know why she wants to remove the trees; but, she would guess it would be for abetter view.  She said that her concern is that these are pretty much the only trees between the house and the road and the slope is fairly steep.  She said that there is no plan to replace these.

Chairman Murley said that none of the trees pose a threat to the house and none of them area dead and if they are being removed to create a view corridor, the Applicant needs to file at least an RDA if not a Notice of Intent.

Based on the information provided, it was agreed that the Applicant needs to make a more formal filing with the Conservation Commission.  Deputy Usowski said she will try to get some additional information about the project.

Deputy Usowski informed the Commissioners about an upcoming workshop on invasive species.  She distributed copies of a letter regarding the Dogs at Rock Harbor issue written by Mr. Hoerle.


























There was no further business.  Mr. LaBranche MOVED to adjourn at approximately 10:26 P.M.  Mr. Smith SECONDED the Motion.
